JNC Partners Group, Inc. (“Allinsure Group”, “us”, “we”, or “our”) respects your privacy. This Privacy Policy is designed to help you understand how we collect, use and disclose the Personally Identifiable Information you decide to share, the type of information we receive about you from third-parties, and help you make informed decisions when communicating with us through our website located at http://www.allinsuregroup.com, by sending us email through our portal, by text, and other means as further described in this Privacy Policy (collectively, the “Services”). In this Privacy Policy, “you” means the user of our Services, including the individual applying for an insurance policy, the individual that submits an insurance application or contacts us on behalf of another individual, or the individual that enrolls into a qualified health plan.

This Privacy Policy only applies to the Personally Identifiable Information we receive from the Services. Because our Services give you the ability to search for insurance policies sold through the Federally Facilitated Marketplace, we are required by contract with the Centers for Medicare & Medicaid Services (“CMS”) to comply with all applicable federal and state laws, including the standards established to protect the privacy and security of Personally Identifiable Information under 45 C.F.R. 155.220(c) and (d) and 45 C.F.R. 155.260. However, other organizations may have their own privacy policies governing the use of information you provide to them, which may be different from our Privacy Policy. For example, we may include a link for you to connect with us on Facebook or to follow us on Twitter; each of these companies has their own privacy policy and practices and they may not be required to comply with federal laws to protect the privacy and security of Personally Identifiable Information.

BY USING THE SERVICES, YOU AGREE WITH ALL OF THE TERMS OF THIS PRIVACY POLICY AND CONSENT TO THE COLLECTION, USE, AND DISCLOSURE OF INFORMATION AS SET FORTH IN THIS PRIVACY POLICY. 1. The Information We Collect, Use and Disclose
1.1 Personally Identifiable Information We May Collect and How We May Collect the Information

“Personally Identifiable Information” is information that identifies you or that, when combined with other available information, can be used to identify you. Personally Identifiable Information includes, for example, your name, birth date, social security number, telephone number, e-mail address, physical address, and Federally Facilitated Exchange applicant ID or member ID. Personally Identifiable Information also includes your date and place of birth, your mother’s maiden name, and unique device identifiers.

(A) We may collect Personally Identifiable Information in a variety of ways, including when:

  • You use the functions or features on the Services, such as when you complete an insurance inquiry form on our website, or authorize us to send you reminders by e-mail or by text message.
  • You contact us to request information by sending us an email or sending us a text message. NOTE: If you are sending us e-mail through a means other than through our portal, please be aware that regular e-mail is not a secure form of communication. Please do not include your social security number, your birthdate, or any other sensitive information. If you cannot use our portal, please call us instead.
  • You register for an account with our Services.
  • You register to receive our newsletter, for a webinar, or other service through our Services.
  • You pay for services using your credit card or other payment option we make available to you.
  • You submit comments to us through a contact form.
  • You authorized a third party with whom you have or had a relationship to provide us information about you. For example, we may receive Personally Identifiable Information about you under an agreement with our Business Partners (e.g., CMS, health insurance issuers, licensed agents, health care providers, third party administrators and other vendors).

(B) We may use and disclose Personally Identifiable Information in the following ways:

  • To keep a record of your contact information and correspondence and use it to respond to your inquiries, fulfill your requests, and assist you with purchasing a qualified health plan, including assistance with applications, plan selection and comparisons, tax credits and cost-sharing reductions, appeals, and eligibility changes.
  • To identify you to anyone to whom you contact through the Services.
  • To transmit information about you to authorized Business Partners and other third parties (e.g., enroll/disenroll in a qualified health plan, report eligibility changes, correct application errors).
  • To identify you to your employer or employees, as applicable.
  • To provide assistance with communicating with your qualified health plan or to facilitate your communication with an insurance agent, an HSA/HRA vendor, trustee, or administrator.
  • To facilitate payment of the initial premium amount to the appropriate qualified health plan; educate you on insurance affordability programs; and provide Medicaid/CHIP eligibility information when applicable.
  • To send you reminders about your insurance enrollment (renewal notices, deadlines, missing information, life events that impact eligibility).
  • To provide you with appropriate information, materials, and programs to inform and educate you about the use and management of your health information and services/options offered through your plan.
  • To use survey information for research and quality improvement purposes.
  • To carry out legal responsibilities related to qualified health plans as permitted by our contracts.
  • To send you administrative information regarding our Services (support hours, policy updates, feature updates).
  • To operate our business, including limited access by workforce members, independent contractors, and third-party service providers (hosting, storage, IT, customer service, email delivery, analytics, fraud prevention, chat, optimization, etc.).
  • To a third-party in the event of reorganization, merger, sale, joint venture, assignment, transfer or other disposition of business, provided such transfer is permitted by CMS and applicable state regulators.
  • As you expressly authorize, to the extent permitted by CMS and applicable law.
  • With subsidiaries or affiliated entities to the extent permitted and subject to this Privacy Policy, applicable laws, and agreements.
  • Other substantially similar functions or those approved by CMS, including (where not precluded) improving our Services, identifying usage trends, and expanding offerings.
  • As necessary or appropriate (to the extent permitted by CMS and law): comply with legal process; respond to government requests; enforce terms; protect operations against security threats, fraud, or malicious activity; protect rights, privacy, safety or property; pursue remedies or limit damages.

(C) Personally Identifiable Information and Third Party Data Sources

We may obtain your Personally Identifiable Information from affiliated entities, publicly available databases, and other independent third-party sources (“Third Party Data Sources”) and add it to our contact database for marketing and sales purposes and to combine it with other information that we have collected or obtained from you otherwise. We will only do so to the extent not precluded by CMS or applicable law, or if you authorize us (e.g., via another website or affirmative consent).

(D) Personally Identifiable Information and Marketing

To the extent not precluded by CMS or other applicable law, we may use Personally Identifiable Information to send you marketing communications and promotional material about other products and services. You may opt-out at any time using the unsubscribe link or other opt-out options in the communication. We may disclose your information to third-party marketing service providers under binding obligations to maintain privacy and security.

1.2 Other Information We May Collect

“Other Information” is any information that does not reveal your specific identity or does not directly relate to an individual (e.g., device info, cookies, demographics, aggregated data). If we combine Other Information with Personally Identifiable Information, we will treat it as Personally Identifiable Information while combined.

(A) How We May Collect Other Information

  • Through your browser or mobile device (e.g., OS, browser type, language, device model).
  • Using cookies, web beacons, and similar technologies (including HTML5 local storage). You can control cookies in your browser.
  • IP address (logged automatically in server logs and/or analytics tools).
  • Analytics tools and third party services (e.g., Google Analytics) may collect usage and feature metrics.
  • By aggregating information for statistical and service improvement purposes.

(B) How We May Use and Disclose Other Information

We may use and disclose Other Information for any purpose except where restricted by our CMS agreement or law. If required to treat identifiers as Personally Identifiable Information, we will do so as described above.

2. California Do Not Track Notice

We do not track you over time and across third party websites to provide targeted advertising and therefore do not respond to Do Not Track (“DNT”) signals. Third parties that have embedded content on our Services may set cookies and track you across sites; please read their privacy policies for how they respond to DNT.

3. How We Communicate With You

We may communicate via email, phone, text messages, and postal mail using the contact information you provide. By providing such information, you consent to being contacted, including by autodialed or prerecorded calls/texts for service-related purposes (e.g., support, billing, insurance information, collections). We and our service providers will not use autodialed/prerecorded calls or texts for marketing without your prior express written consent. Standard charges may apply. You can revoke consent (e.g., reply STOP to SMS) using the methods on our Contact page.

By providing your email address and phone number, you agree to allow Allinsure Group to send you advertising and promotional information via email and SMS. You also allow Allinsure Group to call you.

“No mobile information will be shared with any third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with or obtained by any third parties.”

4. Our Commitment To Data Security

We comply with applicable federal laws, including 45 C.F.R. § 155.220(c) and (d) and 45 C.F.R. § 155.260, to protect the privacy and security of Personally Identifiable Information.

4.1. Our General Security Practices

We use commercially reasonable administrative, physical and technical controls to protect your information. We use encryption technology such as SSL for certain communications (e.g., transmitting information to the Federally Facilitated Exchanges, account registration). Other communication may use HTTP or regular email, which are not encrypted; do not send sensitive information via unsecured means. Look for “https” or a lock icon to confirm SSL.

4.2. Your Obligations
  • Secure your devices, use antivirus and a firewall.
  • Change default router/Wi-Fi passwords and use secured Wi-Fi.
  • Use strong passwords.
  • If you believe your interaction with us has been compromised, notify us immediately via the Contact page.
5. Third Party Services and Links

This Policy covers only our collection, use, and disclosure. Our Services may link to third-party sites/services (e.g., social networks). We do not control those sites or their privacy practices. Review their policies to understand how they handle your data. We are not responsible for practices of your ISP or wireless carrier.

6. Choices, Access, Corrections, and Data Retention
  • Amend/Correct/Substitute/Delete PII: Contact us via the Contact page. We may require written requests, proof of authority/identity, and may charge permitted fees. If denied, we will explain and provide appeal options (if any). We will respond within no more than 10 working days.
  • List of Disclosures: You may request a list of certain disclosures to third parties, subject to exclusions (e.g., workforce, necessary to perform services, older than 10 years, or no longer existing records). Permitted fees may apply.
  • Right not to provide information: You may choose not to provide information; some features may require it.
  • Object to new uses/disclosures: We will seek your authorization for new uses not described in this Policy or permitted by law.
  • Revoke authorization: You may revoke your authorization prospectively via the Contact page.
  • Request restrictions: You may request limits on our use/disclosure; this may limit our Services.
  • Block cookies: Use browser settings; some features may not function.
  • Block marketing: Opt-out via unsubscribe/opt-out options (where not prohibited by CMS or law). Administrative/security notices are not optional.

You may update information via the Contact page. We retain information as long as needed to provide services, comply with obligations, resolve disputes, and enforce agreements.

7. Use of Services by Minors

We do not knowingly collect Personally Identifiable Information from individuals under 13, and the Services are not directed to individuals under 13. Please do not use the Services if under 13.

8. International Visitors

The Services are controlled and operated from the United States and are not intended to subject us to the laws or jurisdiction of any state, country, or territory other than the United States. By using the Services, you consent to the transfer of information to the United States, which may have different data protection rules than your country.

9. Updates To This Privacy Policy

We may change this Privacy Policy from time to time. See the “Last Updated” legend at the top of this page. Non-material changes are effective upon posting. For material changes, we will post a notice or email you a link to the updated Policy. Your continued use following non-material changes or 10 days after material changes signifies acceptance.

10. Performance, Governing Law, and Jurisdiction

We will use commercially reasonable efforts to comply with this Privacy Policy. The laws of the State of Florida, without regard to conflicts principles, govern this Policy. Exclusive jurisdiction and venue lie in the state or federal courts located in Miami-Dade County, Florida. Each party waives the defense of inconvenient forum to the fullest extent permitted by law.

11. Official Version of this Privacy Policy

We may make this Privacy Policy available in multiple languages. In the event of a dispute about interpretation, the English version controls. All proceedings related to this Privacy Policy will be conducted in English.

12. Severability and Waiver

Our failure to exercise or enforce any right or provision of this Privacy Policy will not constitute a waiver. If any provision is unlawful, void, or unenforceable, the remaining provisions remain in full force and effect to the fullest extent under applicable law.
